Abstract This article deals with the sources of European Law with particular reference to the way the latter are re-systemised with respect to the draft of the European Constitution. First of all this article underlines the primacy of European law over the law of the Member States. It then goes on to illustrate the basic features of the new European sources of law and, in particular, the differences with respect to the consolidated system. Finally the article looks at the elements that, on the basis of the draft constitution, are used to systemised the European sources of law and their similarity with those conventionally employed by the legal sytems of the Member States. |
