Abstract The European economic constitution has a consolidated substantial configuration which is based on and legitimised by the push towards transnational economic sovereignty which is a response to phenomena such as globalisation and the fiscal crisis of national states. This particular feature explains why the European Constitutional Treaty project will not be able to substantially change the configuration of the European economic constitution and simply consitutionalises the framework and rationalises some of the structures and procedures. This is illustrated in detail with reference to single areas (market, monetary, financial and budget policies of the European Union). This essay, especially the conclusion, underlines an important limit to the European Economic Constitution i.e. the fact that it only considers the «stabilising» element of economic processes and is unable to effectively influence the policies and «governance» of these processes which, to a large extent, are beyond the control of the States which are bound to the Stability Pact and to the risk of fiscal crises. As a consequence, in a transnational context, it is essential to control political action, including the development of rights, but at the same to carefully maintain stability without repeating the mistakes of the Welfare State. |
