Abstract Although the institutional framework is still within the domain of the Member States, European integration exerts an influence on the process of devolution. The proposal of the Raffarin Government approved with a Constitutional Law on 28th March 2003 is coherent with the acquis of 1982 as it introduces a series of legal reforms and recognises the principle of subsidariety. However certain elements do not bring the State to take into consideration the wishes of the local government entities in oder to deal with the impact of European law on their competences. The problem of participation of French local government entities in drafting – at national level – of European law has not been addressed because these entities do not considered themselves as counterparts with respect to the European Union and have not realised the centralising effect of European law. |
