Abstract Despite certain technical differences, the constitutional systems of Denmark, Norway and Sweden accepts integrally the principle of the control of the constitutionality of laws executed by the ordinary courts of law (with the respective Supreme Courts in a very eminent position), arranging it in a way that is peculiar – from an overall comparative constitutional perspective – of this Scandinaviancountries. The historical and constitutional roots of this model, from the origins until recent trends, are highlighted in this essay, that aim to analyse the subject from both constitutional theory and constitutional practice. |
