Abstract The Author highlights three important aspects of the notion of democracy contained in the European Convention on Human Rights. First of all he briefly summarises the case law of the Strasbourg Court related to art. 3, Prot. 1 of the Convention i.e. the principle of free elections. On the basis of this principle the Court has established that one has the right to vote and the right to be elected. Second, the Author analyses the main concepts contained in the case law of the Court with regard to the notion of “democratic society” which articles 8-11 of the Convention consider to be limits to civil rights that are recognised in the Convention itself. Finally, the Author examines more recent case law concerning the dissolution of a number of political parties by the Turkish Constitutional Court and he looks at the different effects that these decisions have had. |
