Abstract The French constitutional law of March 28, 2003, regulating the «decentralised organisation of the Republic», provides a new dimension to regionalization without reforming the unitary structure of the state. In the first part the reader can find a review of the innovative features of the constitutional law; in the second part particular attention is given to the rules reforming the rights of overseas entities. The law establishes a new distinction between overseas departments and regions grounded on the principle of legislative assimilation, and overseas collectivities ruled by the principle of legislative speciality. The new legal framework eliminates the traditional category of Territoires d’outre-mer, and increases the powers of local assemblies by conferring an asymmetrical shape to the settlement concerning overseas entities. |
