Abstract

The Author deals with one of the problems inhering the new version of art. 117 paragraph 1 of the Italian Constitution, after the changes brought by the constitutional reform in 2001. The essay focuses on the circumstance that the Italian legislation now meets not only the limitations arising from the Italian Constitution and from the European Union: it must also observe the rules coming from the international treaties signed by Italy. The Author underlines that since 1958 the same requirements must be fulfilled by the French Parliament. In order to make a comparison with Italy, the essay depicts the situation in the French system, especially focusing on the analysis of the case law of the Conseil constitutionnel, Conseil d’État and Cour de Cassation. The French example is useful in order to understand the features of such restrictions. As a matter of fact, most of the problems Italian legal scholars are now faced with have already been dealt with by French scholars. Even though the constitutional framework of the two countries is different, the French model could help to find interesting solutions to problems arising in Italy.
