Abstract

After examining the historical and legislative background, the essay highlights the developments of the relationship, on one hand, between the Catholic Church and the French State (with reference to the loi de séparation of 1905) and, on the other, between Islamic minorities and the French nation. In particular the essay examines the recent legal trends that effect the constitutional principle of secularity (article 1 of the Constitution of Fifth Republic). The essay also focuses on the influential administrative case law of the Conseil d’État on religious issues which is strictly related to the case law of the Conseil constitutionnel on fundamental principles. Moreover, particular attention is devoted to the recent loi sur la laïcité of 15th March 2004.
