Abstract The Author analyses the most recent constitutional reform in Greece (2001) as an example of a new wave of constitutionalism that characterizes the so-called risk society (Risikogesellshaft). Main aspect of the new wave is the effort to deal with the dangers and insecurities of the postindustrial age by amending the constitution with regard to matters that involve public powers. The strengthening of the effectiveness of citizens’ rights, the constitutional protection of ‘new rights’, the codification of the principles of horizontal effect and proportionality are significant aspects of the Greek reform. According to the Author, they are all the expression of a common trend: the return to the original function of the Constitution i.e. an instrument of protection strictly related to the insecurity of citizens in post-modern society. |
