Abstract Human rights without constitutional and judiciary guarantees do not exist; therefore a modern constitutional State must provide legal proceedings for an effective and true protection of all human rights. On this line, the article analyses the oldest constitutional guarantee of all human rights in particular personal liberty: the writ of habeas corpus, a guarantee which characterizes Western civilization. The article then goes on to clarify how the writ of habeas corpus was adopted at a constitutional level in Latin America during the 19th Century then it examines its evolution and the present situation on the basis of the present-day legal and constitutional order. |
