Abstract The article deals with the most recent developments in Iraqi constitutional law, looking first at the provisional constitution of 2004, and then at the permanent constitution approved with a referendum in October, 2005. Consolidation prospects for the “new-born” Iraqi democracy are examined in the light of the conflicts between different ethnic and religious communities in the country. In this context, the role of the Koran law within the Iraqi legal system is a particular subject of focus during the transitional phase, subsequent to the collapse of Saddam’s government in 2003. |
