Abstract Project financing is a special financing technique employed both in the field of private and public law. In Italy, no general definition of project financing can be found; where as a specific application of the technique is a noun in the field of the Merloni law concerning public works. The procedure designed by the law is as follows: a private subject, as a sponsor, can propose the carring out of a public work to the public administration. In this case, he supports at least partially the expenses and earns the benefits from running. The project is evaluated by the administration and accordingly a double competition is established, a contract on the basis of the project proposed by the promoter and another one in which the participants are the promoter himself and two competitors who have presented the best offers in the first competition. In this context, the new procedure of competitive dialogue (directive CE 2004/18) seems particularly appropriate for the Italian project financing structure. |
