Abstract In the French system, while the expression “Project financing” is generally unknown, the concept of “Partenariat Public Privé” (PPP) exists. It must be considered as including all the different ways in which the public sector cooperates with the private one, in order to achieve general interests. Such a concept is quite vast because it embraces various patterns of agreement, such as the societés d’économie mixte (SEM) which are a kind of joint venture, besides grants (délégation de service public) and public tenders (marchés publics). Only in 2004, a new type of agreement was introduced: Partenariat Public Privé agreement or PPP. Resulting from the European regulation concerning so-called “competitive dialogue”, it is more flexible than the above-mentioned legal notions. |
