Abstract

In this article the author analyzes the main instruments of administrative simplification that have been introduced into the British and American legal systems over the last 15 years. With regard to Britain, attention is focused on partnership governance, which has reshaped local government, within the context of wider changes to the administrative system with a shift towards socalled “collaborative spaces”. As a result British government has shifted from the government of a unitary state to governance in and by networks. With regard to the U.S.A., which has a system that is very different from the British one, analysis focuses on instruments of simplification, such as alternative dispute resolution and “reg-negs” as the starting point for rule-making. Moreover, the author underlines how some instruments of simplification have deviated from their original goal. For example, the progressive extension of regulatory impact analysis has made proceedings more complicated and concentrated check powers in the hands of the President.
