Abstract In France, the State has been modernised in various ways with the aim of improving the way public administration operates and strengthening the relationship with the subjects involved in the administrative procedure. Several laws have been approved over the last few years (above all, loi n.321 du 12.04.2000) in order to increase the transparency of public administration and the access to public documents as well as to strengthen non-jurisdictional administrative procedures and to favour the involvement of the private sector. Choosing to value the involvement of the private sector is at the basis of strengthening the consensual tools adopted by the administration itself. The main novelties in this sphere are the changes in the discipline of the marchés publics carried out with décret n.15 du 7.01.2004 and the introduction of the contrats de partenariat with ordonnance n. 559 du 17.06.2004. |
