Abstract This article deals with the problem of Israeli refugees coming from the Gaza belt when the Israeli government decided they must leave in the years 2004-2005. The first two paragraphs discuss the problem from a political perspective; describing how Sharon succeeded in realizing the plan, and briefly explaining the Israeli legal system (including the Supreme Court’s wide powers). The article goes on to discus the legal means the Sharon Government used (including the forced demission of two ministers), and the position the Israeli High Court of Justice had on the evacuation. The article concludes by discussing the decision on the day of the evacuation, on the army’s powers in time of peace, on the problems of conscience of the soldiers in order to obey the evacuation orders, and on the matter of destroying the synagogues in the areas; abandoned or not. |
