Abstract The essay analyses the French and Italian Constitutions from a comparative point of view, with particular regard to the issue of the incapacity of the President of the Republic. In both texts the President of the Upper Chamber is singled out as the substitute of the President, even if the role of the Head of the State is very different in the two countries. The analysis underlines a dangerous lack of regulation concerning the problem of presidential illness. |
