Abstract The draft of the Service Directive approved by the European Parliament and known as the Bolkestein directive has eliminated an essential element contained in previous drafts. The country of origin principle has been substituted by a clause entitled “freedom to provide services”. The Parliament’s restrictive amendment is aimed at avoiding companies opting for basement in countries with very little regulation and low standards of safety and environmental protection. In the author’s opinion even the original version did not risk undermining EC workers’ guarantees because most of them were already protected under Posting of Workers Directive. Moreover, the Rome Convention on the Law Applicable to Contractual Obligations disciplines most of the other employment conditions, according to the criterion that assigns jurisdiction to the national law of the service providers and according to the principle of the “country of origin”. |
